Marie Tribe of Chippewa Indians has for years wanted to build a casino adjacent to the Lansing Center on East Michigan Avenue. On Tuesday, the tribe's governing Board of Directors approved a resolution authorizing the tribal chairman and attorney to "take whatever action is necessary and appropriate to challenge and overturn the denial," up to and including a federal lawsuit.  "We are continuing to work with our legal counsel to make sure we have pursued every available option," John Wernet, the tribe's general counsel, said in an email to the State Journal, "but it seems likely that a lawsuit will be necessary to vindicate the Tribe's clear statutory right to have these lands placed in mandatory trust status."  He could not specify a timeline for the challenge but said "this matter is of vital importance to the Tribe and we intend to move expeditiously … we continue to be very confident that we will prevail."  The Sault Ste. Marie Tribe currently owns five casinos , all of them in the Upper Peninsula. The tribe had applied to entrust the land in Lansing and more property in New Boston, southwest of Detroit.   The tribe had argued that federal law requires the government to entrust certain property purchased for "enhancement of tribal lands," but the Interior Department said this summer the tribe failed to prove the casino plans would accomplish that. Two other Michigan tribes who own casinos and have opposed the Lansing casino plans, the Nottawaseppi Huron Band of Potawatomi and the Saginaw Chippewa, are ready to join a legal fight against the project, a spokesman said Wednesday.  "We will monitor this situation on a daily basis and prepare for participation in the litigation," spokesman James Nye told the State Journal. "We would seek to vigorously defend Interior's logical decision to deny the Sault tribe the ability to open numerous casinos hundreds of miles from its reservation."   Part of the Interior Department's denial said the tribe could not prove that the Lansing and New Boston properties would benefit the tribe's headquarters about 300 miles away.  There are currently 23 tribal casinos in Michigan, according to the state Gaming Control Board, plus three commercial casinos in Detroit. She would not reveal the exact location of where the animals would be relocated. Woodyer admitted that Obbard did not identify himself to Spruce Haven Zoo owners during his recent visit and did not ask owners any questions about the facilities or their qualifications. “We know in the past they won’t talk to us and are not open to any discussion and they’ve seen the reports in the past and the issues haven’t been dealt with,” Woodyer said in a telephone interview. Obbard, who spent years in the wildlife research department of the ministry conducting long-term studies on ecology, population dynamics and behaviour of black bears in various parts of Ontario, has findings similar to those reports commissioned in the past by Zoocheck.  The report concludes that Spruce Haven Zoo does not meet the needs of carnivores housed there and the zoo, itself, is not meeting several regulations under the Ontario Society for the Prevention of Cruelty to Animals Act.
